What is an unregistered property?

An unregistered property is a house, building, or plot of land that hasn’t been recorded with HM Land Registry. These properties lack official documentation such as title deeds or land certificates, which are typically used to prove ownership and transfer property rights. As they’re not recorded in the Registry System, they are far more challenging to sell through traditional methods. However, they still make up a substantial 14% of freehold land in England and Wales.

HM Land Registry was established in 1862 and is responsible for recording property ownership in England and Wales; its purpose is to facilitate property transactions and prevent unlawful disposal of land. The system provides property owners with a land title guaranteed by the government, as well as a title plan that indicates the property boundaries.

Registration

Registration is compulsory in certain situations, such as when transferring ownership (e.g. sale, inheritance, gifting), when mortgaging the property, or when leasing the property for seven years or more.

Selling an unregistered property can present unique challenges. For instance, many mortgage providers may be reluctant to finance the purchase of an unregistered property. However, this doesn’t mean selling is impossible – and that’s where Gaffsy comes in. We specialise in helping you sell your unregistered property quickly and easily, offering a cash purchase to sidestep many of these complications.

How do I register an unregistered property?

If you discover your property is unregistered and wish to register it before selling, here’s a step-by-step guide.
The registration process can vary in complexity and duration. Simple cases might be resolved in a few weeks, while more complex situations involving ownership disputes or missing documents can take several months or even over a year.
  • Submit a K15

First, submit a K15 form to the Land Charges Department. This search provides crucial information about land ownership dating back to 1925.

  • Gather documentation

Next, acquire all relevant property documents, including any historical deeds or agreements.

  • Complete FR1 form

You’ll then need to fill out a FR1 form – this is the application for first registration of your property.

  • Create a property plan

This is a scale drawing of your property boundaries.

  • Pay the registration fee

Finally, calculate and pay the registration fee; these fees will vary based on the value of your property.

  • Submit application

You submit your application by sending all of the above documents to HM Land Registry. If you’re purchasing an unregistered property, you’ll also need to include a TR1 (whole transfer) form with your application.

What costs are associated with registering a property?

There are some costs associated with registering an unregistered property, that you should be aware of. These can include:

  • Government registration fees
  • Legal fees for document preparation and filing
  • Surveyor fees for boundary verification
  • Property transfer taxes and duties
  • Settlement of any outstanding debts on the property

Given the potential complexities and time involved in registering an unregistered property, many property owners opt for a faster solution.

At Gaffsy, we specialise in buying unregistered properties, offering a quick and hassle-free alternative to the registration process. Our team is experienced in handling the unique challenges of unregistered properties, allowing you to sell your property quickly without the need for registration.

Preparing to sell your unregistered property

Before you can sell, you need to gather some crucial documentation. First, locate the original title deeds; these are physical documents that prove your ownership. If you’ve had a mortgage, your lender might be holding them. If the title deeds are missing, you’ll need to complete an ST3 form (Statement of Truth) for the Land Registry, explaining why the deeds are unavailable. Support this with evidence of your ownership and residency, such as utility bills, mortgage payment records, electoral roll entries, and a copy of the original sale contract.

Conveyancing

When selling an unregistered property, your conveyancer will perform several important tasks. They’ll conduct an Index Map Search with the Land Registry, verify all provided deeds, and check relevant documents from the past 15 years to ensure a clear title chain. The conveyance will also examine additional information like marriages, bankruptcies, stamp duty payments, and any title defects.

Once you’ve prepared these documents, you can then decide on a route to sell your unregistered property.

Methods to sell your unregistered property

There are four main methods to consider when selling your unregistered property: selling through an estate agent, selling at a property auction, conducting a private sale, or selling to a quick house buyer like Gaffsy. Each offers distinct advantages and disadvantages, let’s have a look at them in detail:
  • Selling through an estate agent

Using an estate agent offers professional marketing and wide exposure, with the agent handling viewings and negotiations. The main appeal of this method is that it has the potential to achieve maximum market value for your property. However, commission fees can be substantial, the process can be lengthy (especially for unregistered properties), and there’s no guaranteed sale.

  • Selling at a property auction

This can be a quick process, typically completing within 28 days, and you’ll have the peace of mind of a definite sale date. Also, the potential for competitive bidding means you could receive a very good price for the property. On the downside, there’s a risk of selling below market value if bidding is low. You also have limited control over the final sale price when selling through an auction, and will need to factor in auction fees.

  • A private sale

With this method, you have complete control over the process, flexibility in negotiations, and no commission or fees to pay. However, it can be time-consuming and potentially stressful, with limited marketing reach compared to professional services. Navigating the legal complexities of selling an unregistered property can also be difficult when selling on your own, especially if you lack experience.

  • Using a fast cash buyer

Selling to a quick house buyer like Gaffsy is often the fastest method to sell an unregistered property. It offers a guaranteed sale, often within days, with no fees or commissions. Companies like Gaffsy also have expertise in handling unregistered properties. The main drawback is that the offer might be below full market value (at Gaffsy we offer approximately 80% of market value).

Mr P wanted to sell his house after his ex-wife passed away. Gaffsy was able to help Mr P navigate the complicated process of proving ownership in order to facilitate the sale. We purchased the property quickly and exchanged and completed simultaneously.

Hampton Road

Mr O wanted to sell his property which was being squatted in. He had been unable to evict the squatters and found himself in a very difficult situation. Gaffsy stepped in and purchased the property with the squatters in place. We purchased the property without viewing it as arranging access was impossible.

I recently used Gaffsy to sell a house on behalf of an elderly Uncle of mine.
This sale was not a straightforward one by any means. It involved a property that had squatters that had taken up residence over a period of years.
I would like to say the way Gaffsy handled this matter was nothing less than exemplary, I dealt with a gentleman named Oren Kander who, with all the problems involved, was extremely polite and helpful.

All my uncle’s legal fees were paid for by the company and I received up-to-date emails on the progress of the sale. I cannot praise this company highly enough.

How to sell an unregistered property FAQs

Below we have compiled some of our most commonly asked questions when it comes to unregistered property and land sales. However, if you have any further queries don’t hesitate to get in touch.
Can you still buy my property fast if it is unregistered?

Yes, absolutely! At Gaffsy, we specialise in buying unregistered properties quickly. Plus, our expertise in handling the complexities of unregistered property sales means we can often complete the purchase faster than traditional methods. We understand the obstacles involved and have processes in place to ensure a smooth, rapid transaction. With our quick service, you’ll sell your unregistered property without the usual delays or complications, in as little as a week.

Can a private buyer get a mortgage to purchase an unregistered property?

While it’s possible for a private buyer to obtain a mortgage for an unregistered property, it can be much more tricky. Many lenders are hesitant to provide mortgages for unregistered properties due to the increased risk and complexity. However, some specialist lenders may offer mortgages with additional requirements, such as the buyer agreeing to register the property upon purchase. If you’re looking to sell an unregistered property, working with a cash buyer like Gaffsy can bypass these mortgage-related complications entirely.

Do you need to register a property before selling?

No, you don’t necessarily need to register a property before selling it. However, registering can make the selling process smoother and potentially increase the property’s value. If you choose not to register, you can still sell an unregistered property, but you’ll need to provide alternative proof of ownership, such as original title deeds. At Gaffsy, we’re experienced in buying unregistered properties, so you can sell your unregistered property to us without going through the registration process.

Why would a property or land not be registered?

A property or land may not be registered for several reasons:

  • Historical factors, such as properties passed down through inheritance
  • Incomplete or missing documentation, like title deeds or surveys
  • Ongoing legal disputes or unresolved issues related to ownership or boundaries
  • Some property owners avoid registration due to the perceived cost and complexity of the process
How can you prove you are the owner of an unregistered property or land without the title deeds?

If you need to prove ownership of an unregistered property without title deeds, you can provide alternative evidence to the HM Land Registry. Acceptable forms of proof include: An ST3 form (Statement of Truth) along with supporting evidence Records of mortgage payments Electoral register records showing your residency A copy of the original contract of sale Inheritance documents, if the property was passed down to you Utility bills in your name for the property Land Registry search results showing no other registered owner

We contacted all the companies that pop up first in a Google search. All promised alot and wasted a year of my time. Ignore all the other companies for your peace of mind, there is no care or concern for your real life situation. All tried to lower their offer just before exchange after all the conveyancing had began. From the very first phone call to exchange and completion, Oren @gaffsey gave a fair price, he was completely transparent. kept us completely in the loop did not change his offer and paid the Solicitors costs. The local authority made an offer to reclaim the leasehold but still gaffsey gave the best deal and wrapped everything up in just over 2 months. We managed to purchase and move into our new home seamlessly. Again thank you for your integrity, honesty and fairness Oren is a decent upstanding human being and I whole heartedly recommend his company. None of the other companies can compare.

This company sadly wasted alot of our time and kept reducing the offer to a ridiculous amount and even then pulled out. We were selling an high rise serviced apartment which had high service charge due to our original buyer pulling out and we had a forward purchase. The buyers pulled out advising that "It was a severe misrepresentation, no one with their head screwed on would touch that flat with that SC situation and I think you know that", which seemed like a rude response when we had been clear with them all the way, that the service charge was high due to having had cladding works done. We were advised by the managing agents that the increase had happened due to insurances and would come down, and advised the buyer of this. I didnt realise that they had already come down alot from previous years. The buyer knew that we were planning to buy a new build with the funds so had requested a speedy purchase in the first instance, however they dragged their feet and pulled out as they hadn't done their own due diligence. In the end we ended up selling the property for £11,000 more to a more reputable cash buying company who completed within 2 weeks. Please dont fall for their marketing slogans and look for more reputable firms id say. In the end we are glad we didnt sell to this firm at such a low valuation.

I had my London flat on the open market with numerous traditional estate agents for several months and, despite plenty of viewings, there was very little genuine interest and no meaningful offers. The process became incredibly disheartening — particularly as I didn’t always feel that agents were being fully transparent with me about the realities of the market or what was realistically achievable for the property. At my sister’s suggestion, I began exploring the option of working with a cash buying broker, which is how I came across Gaffsy. From the outset, Oren Kander impressed me with his open, honest and pragmatic view of both the property and the wider market. There was no fluff or over-promising — just clear communication and realistic advice. Oren worked tirelessly to source the right cash buyer at a fair price, ultimately achieving a successful sale with a two-week completion, which was a huge relief after such a long and frustrating experience on the open market. Throughout the process, he kept me well informed and managed expectations professionally and transparently. I’m really pleased with the outcome and would absolutely recommend that anyone struggling to sell a more complex or troublesome property reaches out to Gaffsy to explore their options. Oren — thank you!

My experience with Gaffsy has been a very unpleasant one. My flat is currently on the market for £200k - reduced from £220k in order to sell quicker, but still it’s been taking a while, so we decided to reach out to cash buying companies. Gaffsy (represented by Ben) initially offered us £160k, which was 80% of the asking price, but we were willing to accept for the sake of quick sale. In order for them to get a better insight of the flat I sent Ben a series of videos of various features of the flat, including a walk-through of the whole flat. There were also photos and the floor plan available on the estate agents’ website. Ben than announced he needed to see the flat for himself before confirming the final offer – not a problem, he was provided with all the details how to get into the flat (which is vacant). He then stated he could not do the visit himself, but someone else will attend and take photos for him – again, not a problem. I asked how reliable the initial offer for the flat was. In his email, IN WRITING, Ben stated: “As there is no formal survey, any adjustment would only be considered following this initial inspection and only if something material came to light that had not been previously disclosed”. He then called me a few days later, stating that “he did not realise my flat had a lowered ceiling”, and “he thought it would be like my neighbours flat, so he got confused (?)”, and then he announced that he would have to offer me a “slightly lower” price - £120k (that’s 60% of the original asking price, and £40k below the initial offer). Clearly, I declined. I found it really staggering how blatantly Ben expected me to believe that having seen: - The walk-through video of the flat - Other videos of distinctive features - Photos on the estate agents’ website - Floor plan on the estate agents’ website with clearly marked lowered ceiling areas … apparently it still took him by surprise that my flat had a lowered ceiling in some parts, to the point he felt compelled to take another 25% off the already reduced offer. That despite his previous assurances in writing that only something “material” and ”undisclosed” would change the initial offer. How exactly does one of the most prominent features of the flat can count as “undisclosed”? I don’t know what he meant by the reference to my neighbour’s flat, but if he in fact had ever bothered to look at the next door flat for some reason, he would have realised that it was mirroring my own flat, including the lowered ceilings, so his lie was unnecessary and completely obvious as a lie. The whole situation felt like he just came up with a nonsensical excuse to lower the initial offer to the max to see if we were desperate enough to take it. Fortunately, we were not. Effectively, my dealings with Gaffsy left me with the impression of being dishonest, luring us in with an acceptable offer, and then the price being lowered apparently because of an obvious feature, despite written (and verbal) assurances it would not happen. They did not even have enough respect to try to come up with a slightly more believable excuse, so desperate were they to give us a bad offer (60%). Altogether, a very negative experience.

The staff were helpful and pleasant, and always available to speak to. If we ever missed a call, they returned it promptly. They made a very good offer on the property, which would have made the transaction extremely straightforward. We ultimately decided not to proceed for personal reasons, and not due to anything on their part. Quite the opposite. When we informed them of our decision, Ben was empathetic and completely understanding. We would certainly recommend Gaffsy as a genuine and helpful company, and they would be our first choice should we decide to sell a property in the future.
